Terms and Conditions for Use of the NiCoach AI Platform

By accessing or using the NiCoach AI Platform (the "Platform"), users agree to these terms and conditions. The Platform is operated by the NiCoach AI Project led by the Principal Investigator at the Hong Kong Baptist University.

1. About the Platform

The Platform is a generative AI chatbot built on large language models (LLMs), a type of deep learning system that can recognize, summarize, translate, predict, and generate text and other content based on knowledge gained from large datasets, including information input by users. Responses on the Platform are generated by LLMs provided through Microsoft Azure OpenAI.

2. Relationship to the Host University (HKBU)

The Platform is a research tool operated by the Project Team and is not operated by or provided as an official service of the host university. Nothing in these terms creates any obligation or liability for the host university beyond application of its policies referenced bellow.

3. Compliance with Host University Policies

Access to and use of the Platform are subject to the host university's policies, guidelines, and regulations applicable to research and use of AI-based services, including but not limited to the Data Governance Policy, Privacy Management Programme, Privacy Policy Statement, Personal Information Collection Statement, and Data Leakage Prevention Policy. For details of the aforementioned policies, please refer to HKBU's official website at HKBU governance policies or learning and teaching governance.

4. Permitted Use

The Platform is provided to invited participants for teaching, learning, and research-related purposes. To ensure fair and efficient use of resources, a daily usage limit may be imposed.

5. Account Security

Users are solely responsible for all activity performed on the Platform using your assigned credentials. Do not share your login information with anyone. If you suspect any unauthorized use of your account, contact the Principal Investigator immediately at chtiat@hkbu.edu.hk.

6. Prohibited Conduct

Prohibited conduct includes, but is not limited to: i) Attempting to hack or otherwise misuse the Platform, ii) Transmitting viruses or malware, iii) Generating inappropriate or unethical content (e.g., content involving academic misconduct, discrimination, violence, or obscenity), iv) Using the Platform for any unlawful purpose (e.g., assisting in academic fraud, violating intellectual property rights, or illegal data collection).

7. Modification and Termination

The Platform is provided on a trial basis and may be modified or discontinued at any time without prior notice. For security reasons, the Project Team reserves the right to terminate users' access without prior notice if abuse or suspicious activity is detected under users' account. Prior to major modifications or suspension of the Platform's key functions, invited users will be notified via their registered email addresses 5 working days in advance.

8. Privacy and Data Handling

NiCoach.ai is an intelligent learning companion, collaboratively led by professional mentors, dedicated to deepening your experiential reflective learning, helping you articulate your thoughts and achieve your goals efficiently. When users use this platform, they are also interacting with their human coach. What they share here is supposed to be part of their learning journey, and their coach will responsibly review it to better support and guide them. Users can think of this platform as a group chat between them, AI agents and their human coach.

The aforementioned recorded data shall be used solely for the security monitoring of this platform and the platform research project itself. Without the user's written consent, the original data containing personal identifiers shall not be shared with any third-party organizations or individuals. If the anonymized statistical data is to be published externally, it will further comply with the academic achievement publication standards of the host university.

9. Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of Hong Kong. The courts of Hong Kong have exclusive jurisdiction over any dispute arising from these terms and conditions. This Service is operated in Hong Kong. If you are located outside Hong Kong, please note that the information you provide will be collected in Hong Kong, transferred to Hong Kong, and used in accordance with the laws of Hong Kong. By using this AI Platform or providing us with information, you agree to the aforementioned collection, transfer, and use of the information.

10. Disclaimer

Not providing any medical diagnosis or licensed psychotherapy, the platform does not provide any guarantees or warranties regarding the accuracy, copyright compliance, legality, or appropriateness of the content accessed through the Services. We do not accept responsibility for the materials accessed or contained within the Services. We do not guarantee the suggestions or recommendations for services offered through the Services.

This platform are generated based on existing datasets, which may contain academic biases or factual errors. Users should verify the accuracy of the output content themselves. The platform is not responsible for errors in research outcomes or academic risks resulting from reliance on AI responses.

11. Intellectual Property Rights

All content on this Platform, including text, images, trademarks, logos, and other materials, is owned by the licensor. No person may use such content in any manner without explicit written permission.
